2 Geo III c.81, 1762  "An Act for widening, repairing and amending, the Road from Hesket, by Yewes Bridge, to Cockermouth, and from thence by Lorton, over Whinlatter, to Keswick, in the County of Cumberland; and from Keswick, by Dunmail Rays and Ambleside, to Kirkby in Kendall in the County of Westmorland; and from Plumgarth's Cross, near Kirkby in Kendall aforesaid, to the Lake called Windermere, in the County of Westmorland; and from Keswick aforesaid, to the Town of Penrith, in the County of Cumberland."

One Gate or Turnpike, in, upon, and across the Road leading out of the Road going from Blencowe, Graystock and Johnby, to Penrith aforesaid, by and near unto the now Dwelling-house of Lancelot Simpson, Esquire; provided nevertheless, That by the erecting and continuing of such Side-Gate, the said Lancelot Simpson, or any future Owners or Occupiers of his said ... House, or any other person or Persons having a Right to a Vesture or Occupation Way through such Road, so to be shut up, be not hindered or retarded in making use of the said Road or Way, as a private Vesture or Occupation Way onnly, at his, her, and their Wills and Pleasure (but not as a Publick Road, or any other Use or Purpose whatsoever) and that without paying any Toll or Duty for going through such Gate, ..."
